Abstract

Drawing on Thomas Aquinas's theology of law, and following incorporation into UK law of the European Convention on Human Rights, this paper argues that fairness for individuals is a necessary but not sufficient condition of healthy social and political life. It argues that collective identities in the UK require more adequate legal protection. Particular attention is given to trade unions.
